Terms of Use

These terms govern your use of the Mito - Learn IMAT website and app. Please read sections 3 and 4 — they describe what this product can and cannot do for you.

1. Who these terms are with

This service is operated by Jason Holweg, Viktoriastraße 3a, 24937 Flensburg, Germany (“we”, “us”). Full details are in the Imprint. By using the website or the app, you agree to these terms.

2. What the service is

Mito is an independent study tool for people preparing for the International Medical Admissions Test (IMAT). It provides study content structured along the official syllabus, practice questions written by us, analysis of your mistakes, a study plan, and progress estimates.

It is educational software. It is not live tutoring and not an official preparation programme. Where the website describes a course, that means a structured set of lessons mapped to the syllabus, not a taught class and not a qualification. It is not advice on your university application.

3. No guarantee of results

Mito - Learn IMAT is a preparation tool. It is designed to make your study time more effective, but it cannot guarantee any particular exam score, ranking, or admission outcome.

Your exam result depends on many factors we neither control nor observe: how much you study, your prior knowledge, the difficulty of the exam in a given year, competition for places, your condition on the day, and chance. Nothing in our content, our marketing, our score or readiness estimates, or any statement by us constitutes a promise, warranty, or guarantee that you will achieve a particular score, ranking, or admission.

Readiness and score estimates are estimates. They are calculated from your activity in the app and are deliberately shown as a range with a confidence level. They are a study aid, not a prediction of your actual exam performance, and should not be the basis for decisions about your application, your university choices, or your finances. A count of correct answers on a mock or practice set, in the app or on the website, is a count for that sitting. It is not an estimate or prediction of your IMAT score.

We prepare our content carefully and correct errors when we learn of them, but we do not warrant that it is complete, error-free, or up to date with every change to the exam. Always verify exam rules, dates, and requirements with the official sources.

Mito, the AI assistant

Mito answers your questions using a large language model. Such models can be wrong, and they can be confidently wrong: an answer may contain inaccuracies, oversimplifications, or statements that do not match the official syllabus. Treat Mito as a study companion, not as an authority. Where an answer matters for your exam, check it against the reviewed lesson content or an official source.

Mito gives no medical, legal, or admissions advice, and his answers are not a substitute for the study material itself. What you type to him is transmitted as described in the Privacy Policy — please do not enter personal information into the chat.

4. Independence

Mito - Learn IMAT is an independent exam preparation platform and is not affiliated with, endorsed by, or associated with the Italian Ministry of University and Research (MUR), CINECA, Cambridge University Press & Assessment, or any participating university.

“IMAT” and other third-party names, trademarks, and logos referred to on this website or in the app remain the property of their respective owners. We use such names only descriptively, to identify the examination our product prepares for. This use does not imply any partnership, sponsorship, endorsement, or approval.

All questions, explanations, and study materials in Mito are our own original work. We do not reproduce official past papers or other protected examination material.

5. Using the service

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app and the website for your own exam preparation. You may not:

  • copy, extract, scrape, republish, sell, or share our content or question bank, in whole or in part;
  • use our content to train, fine-tune, or build a competing product or dataset;
  • circumvent technical limitations or access restrictions;
  • use the service in a way that breaks applicable law, or in a way that would give you an unfair advantage in the actual examination.

All intellectual property rights in the service, its content, its structure, and its design remain with us.

6. Availability

We aim to keep the service available and useful, but we do not promise uninterrupted availability. We may change, improve, restrict, or discontinue features, and we may update content — including corrections that change what you previously saw. The iPhone app's core learning loop works offline, so ordinary internet outages do not stop you from studying there. The website study app needs a connection, because the account, the progress and the purchases live on the account rather than in one browser.

7. Purchases

Access to some features may require a paid unlock. Where purchases are offered through the App Store:

  • Apple is the seller. The purchase contract for the in-app purchase is concluded with Apple, and payment is handled entirely by Apple. We never receive your payment details.
  • Refunds are handled by Apple under Apple's Media Services Terms and Conditions. Please direct refund requests to Apple; we cannot issue refunds for App Store purchases ourselves.
  • Prices are shown in the App Store before you buy, including applicable taxes. We may change prices for future purchases; a purchase you have already made is not affected.
  • Any paid access we describe as a one-time purchase does not renew automatically. There is nothing to cancel.

Where a purchase is offered on the website — the IMAT Pass, a pack of mocks, or a single mock — the contract is with us and payment is handled by Stripe. We do not receive your card number. The purchase is saved to the website account you are signed in with, and it is available in any browser where you sign in to that account. It does not unlock the iPhone app. The iPhone app remains an Apple in-app purchase, and a purchase in one place is not a purchase in the other. Website purchases do not renew.

The website study app requires an account. Creating one means you agree to these terms and to the Privacy Policy, including storage of your answers and progress and the use of that activity to operate and improve the web app. The iPhone app does not use that account.

Website purchases are digital content. By continuing to checkout you ask us to start supplying that content immediately, and you acknowledge that you lose the 14-day right of withdrawal once access has begun.

Deleting the website account removes access. It does not by itself refund a payment. Refund requests for a website purchase can be sent to hello@imatlearn.com. App Store refunds stay with Apple, as described above.

If you are under 18 (or under the age of majority where you live), you may use the service and make purchases only with the consent of a parent or guardian.

8. Liability

We are fully liable for damage caused intentionally or through gross negligence, for injury to life, body, or health, and under mandatory statutory liability such as product liability law.

For slight negligence, we are liable only for breach of an obligation essential to the proper performance of this agreement and on whose fulfilment you may reasonably rely (a “cardinal obligation”), and in that case only for foreseeable damage typical for this type of contract.

Beyond that, our liability is excluded. In particular, and to the extent permitted by law, we are not liable for examination results, failure to obtain a place at a university, lost opportunities, or the consequences of decisions you make based on estimates shown in the app.

Nothing in these terms limits any rights you have as a consumer under the mandatory law of your country of residence.

9. Changes to these terms

We may update these terms — for example when we add features or paid access. The current version is always published here with the date shown at the top. If a change materially affects your rights, we will point it out in the app. If you do not agree with a change, you may stop using the service.

10. Additional terms for the iOS app

The following applies to the app obtained through Apple's App Store, in addition to the terms above:

  • These terms are concluded between you and us alone, not with Apple. We — not Apple — are solely responsible for the app and its content.
  • Apple has no obligation to provide any maintenance or support for the app.
  • In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • We, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
  • We, not Apple, are responsible for the investigation, defence, settlement, and discharge of any third-party claim that the app infringes intellectual property rights.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you.

11. Applicable law and disputes

These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
